Insolvency Practitioners Licensing and Supervision Unit
The Unit is responsible for licensing Insolvency Practitioners, supervising their compliance with the Insolvency Law, its regulations, and related instructions, managing licensing procedures and examinations, reviewing and verifying complaints, supporting the work of the Insolvency Practitioners Committee, and maintaining the Insolvency Practitioners Register.
Licensing Section
The Licensing Section is responsible for receiving applications for the licensing and renewal of Insolvency Practitioners, maintaining the Insolvency Practitioners Register, coordinating licensing examinations, collecting the prescribed fees, and supporting the work of the Insolvency Practitioners Committee.
- Receiving applications for the licensing of Insolvency Practitioners.
- Receiving applications for the renewal of Insolvency Practitioners' licenses.
- Suspending and revoking licenses.
- Referring applications to the Insolvency Practitioners Committee for decision.
- Coordinating with the Examination Committee to make the necessary arrangements for conducting the Insolvency Practitioners examination in accordance with the mechanism determined by the Committee.
- Registering Insolvency Practitioners in the Insolvency Practitioners Register maintained by the Unit once all licensing requirements have been fulfilled.
- Collecting the prescribed fees from Insolvency Practitioners.
- Performing any other duties assigned to the Section.
Insolvency Practitioners Supervision Section
The Insolvency Practitioners Supervision Section is responsible for supervising Insolvency Practitioners, verifying their compliance with the Insolvency Law, its regulations, related instructions, and licensing requirements, reviewing and verifying complaints, supporting the work of the Insolvency Practitioners Committee, and coordinating matters related to insolvency proceedings.
- Auditing the work of Insolvency Practitioners to verify their compliance with the provisions of the Insolvency Law, the Insolvency Regulation, and related instructions.
- Reviewing and verifying complaints concerning Insolvency Practitioners referred to the Section by the Committee, and submitting recommendations to the Insolvency Practitioners Committee for the appropriate decision.
- Verifying Insolvency Practitioners' compliance with licensing terms and requirements.
- Announcing the date of the Insolvency Practitioners examination, including the examination subject, venue, and date.
- Preparing the necessary arrangements and documentation for meetings of the Insolvency Practitioners Committee, notifying members, providing the agenda, and distributing meeting invitations.
- Notifying Insolvency Practitioners whose licenses have been revoked by decision of the Committee where any licensing condition is no longer met, and notifying the courts accordingly.
- Following up on the completion of the licensing requirements for Insolvency Practitioners whose applications have been approved by the Committee established under the Law and the Regulation.
- Notifying applicants of the Committee's decision rejecting their applications.
- Submitting the names of applicants for Insolvency Practitioner licenses to the Unit Director, once the number of practitioners registered in the Insolvency Practitioners Register reaches fifty, for presentation to the Committee to issue the necessary instructions regarding the classification of Insolvency Practitioners.
- Auditing the books and records of Insolvency Practitioners.
- Publishing insolvency declaration decisions on the Unit's website and on the Companies Control Department's website.
- Recording any changes affecting a licensed Insolvency Practitioner immediately upon occurrence, or upon the loss of any licensing requirement, in accordance with the relevant legal provisions.
- Notifying the courts of Committee decisions relating to Insolvency Practitioners handling insolvency cases so that the courts may remove the practitioner and appoint a replacement where required.
- Coordinating with the relevant entities to conduct training workshops explaining the mechanisms for applying the Insolvency Law in order to reduce errors in its implementation.
- Performing any other duties assigned to the Section.
