Filing Complaints Against Insolvency Trustees

This service allows a complaint to be filed against an insolvency trustee so that any breach of the provisions of the Law, the Regulation, or the code of conduct and ethics of the profession can be examined.

Creditors and debtors.

Prepare the following information and documents before submitting the certificate or extract request through the official service channel.

Steps to complete

Review the steps below to understand where each part of the certificate or extract request process is completed.

Submit the complaint by email or in person

In-person may be required
  • The complainant submits the complaint, with the supporting evidence attached.
  • • The Unit records the complaint against the insolvency trustee in a dedicated register and examines it. Where no breach by the insolvency trustee is found, it submits the audit report and its recommendations to the Committee. Where a breach is found, it sends the audit report to the insolvency trustee, who may submit a response within no more than ten working days of receiving it, and the head of the Unit submits the report and the response to the Committee.
  • • The Committee examines the complaint, may request any additional information or hold a meeting if needed, and then takes its decision.

Notify the complainant and the insolvency trustee of the outcome of the complaint

In-person may be required

The insolvency trustee is notified of the Committee’s decision within no more than seven working days of the date the decision requiring rectification is issued. Where the breach is not rectified, the insolvency trustee’s licence is suspended or cancelled.
